Welcome to Booking Wolf (Cocoon Leasing Pty Ltd). By using our services ("Service"), you agree to these Terms of Service ("Terms"). Please read them carefully as they outline the rules, responsibilities, and obligations associated with our offerings.
1. Services Provided
1.1 Discounted Booking Facilitation
Booking Wolf provides a platform that allows you to:
- Search for locations to find travel accommodations or activities.
- View suggestions for third-party marketplaces (e.g., Booking.com, GetYourGuide, Viator, Hostelworld, Tripadvisor, etc., hereafter "Marketplaces") where you might find such accommodations or activities.
- Submit a URL of a specific accommodation or activity listing found on a Marketplace.
- Upon submission of a valid URL from a supported Marketplace, Booking Wolf will attempt to make that exact booking on your behalf with the underlying service provider (e.g., hotel, tour operator) or through the Marketplace, at a discounted price. The discount is achieved because Booking Wolf may forgo or reduce the commission typically earned by the originating Marketplace.
1.2 User Responsibility for URL and Listing Selection
- You are responsible for finding the specific accommodation or activity on a third-party Marketplace and providing us with the correct and complete URL for that listing.
- You acknowledge that the availability, price, and specific details of the listing are determined by the third-party Marketplace and the end service provider, and can change.
1.3 Booking Confirmation & Service Provision
- While Booking Wolf strives to secure your requested booking at the advertised discount, we cannot guarantee that the booking will be accepted or confirmed by the Marketplace or the end service provider. Availability, pricing, and provider terms can change rapidly.
- If your booking cannot be completed as requested (e.g., the item is no longer available at the expected price, the provider declines the booking made through our channel), we will notify you promptly.
- Any payment made to Booking Wolf for an unconfirmed or failed booking attempt will be fully refunded to you within 5-10 business days, subject to our payment processor's timelines.
- Booking Wolf acts as a booking facilitator. The actual provision of the travel accommodation or activity is the responsibility of the end service provider (e.g., hotel, tour operator) found via the Marketplace.
2. Agreement to Third-Party Terms
Crucially, by making a booking through Booking Wolf, you acknowledge and agree that you are also subject to the terms and conditions, privacy policy, and cancellation policy of the third-party Marketplace from which you sourced the URL AND the terms and conditions of the ultimate service provider (e.g., the specific hotel's policies, the tour operator's rules).
Booking Wolf will make reasonable efforts to display or link to these third-party terms during the booking process on our platform, but it is your responsibility to review and understand them.
Your interaction with the final service (e.g., your stay at a hotel, participation in an activity) is governed by those third-party terms.
3. Payments, Refunds, and Cancellations
3.1 Payments
- All payments for bookings made through Booking Wolf are processed via our third-party payment processor (e.g., Stripe).
- You agree to provide valid and current payment information.
3.2 Refunds for Unconfirmed Bookings
If Booking Wolf is unable to confirm your requested booking at the discounted price for any reason (e.g., unavailability, significant price change on the original platform, provider rejection), any payment collected by Booking Wolf for that specific booking attempt will be fully refunded to your original payment method within 5-10 business days.
3.3 Cancellations and Refunds for Confirmed Bookings
- Once a booking is confirmed through Booking Wolf, any cancellation or modification requests are subject to the cancellation and modification policies of the original Marketplace and/or the end service provider from which the URL was sourced.
- Booking Wolf does not set these cancellation policies. We will facilitate your cancellation request with the Marketplace/provider based on their terms.
- Eligibility for refunds for confirmed and then cancelled bookings is determined solely by the policies of the Marketplace and/or end service provider. Booking Wolf will process any eligible refunds passed back by the Marketplace/provider according to their terms and our payment processor's timelines.
3.4 Liability for Direct Payments
Booking Wolf is not liable for any payments you make directly to a Marketplace or service provider outside of our platform's booking process.
4. User Conduct
You agree to use our Service responsibly and not to:
- Submit false, inaccurate, or misleading information or URLs.
- Use the Service for any fraudulent or unlawful purpose.
- Attempt to interfere with the proper working of the Service.
- Use any automated means (e.g., bots, scrapers) to access or use the Service for bulk submissions or competitive analysis without our express written permission.
5. Intellectual Property
The Booking Wolf platform, including its text, graphics, logos, and software, is the property of Cocoon Leasing Pty Ltd or its licensors and is protected by copyright and other intellectual property laws. You may not use our intellectual property without our prior written consent.
6. Third-Party Marketplaces and Links
Our Service involves interacting with and displaying information about third-party Marketplaces. We are not responsible for the content, accuracy, terms, or privacy practices of these third-party Marketplaces or the end service providers. Your use of such third-party services is at your own risk.
7. Limitation of Liability
To the fullest extent permitted by law, Booking Wolf (Cocoon Leasing Pty Ltd) shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from:
- Your access to or use of or inability to access or use the Service.
- Any conduct or content of any third party on the Service, including Marketplaces or end service providers.
- The failure of a Marketplace or end service provider to accept or confirm a booking, or any issues arising from the service provided by them.
- Any errors or omissions in the information provided by third-party Marketplaces.
Our liability is limited to the amount you paid to us for the specific booking facilitation service in question.
8. Modifications to Service and Terms
We reserve the right to modify or discontinue our Service, or these Terms, at any time. We will provide notice of material changes to the Terms by posting the new Terms on our website. Your continued use of the Service after such changes constitutes your acceptance of the new Terms.
9. Privacy
We respect your privacy and handle your personal data in accordance with our Privacy Policy.
10. Governing Law
These Terms shall be governed by and construed in accordance with the laws of New South Wales, Australia, without regard to its conflict of law principles.
11. Dispute Resolution
Any disputes arising out of or related to these Terms or the Service shall be resolved through binding arbitration in Sydney, New South Wales, rather than in court, except that you may assert claims in small claims court if your claims qualify. The arbitration will be conducted by a single arbitrator under the rules of the Australian Centre for International Commercial Arbitration (ACICA).
